At , SBC (BearMar.com) we consider the agreement between us on what this site is *AND* the privacy of our visitors to be extremely important. This policy document describes in detail the types of personal information is collected and recorded by and how we use it.

Purpose

This entire section defines the definition of the word Purpose relative to this site. This sites Purpose is to sell cool or just useful inventions I make.

Links

SBC has links that have users leave the SBC website and go to 3rd party websites. SBC is sometimes compensated by the 3rd parties when users click on that link. The link itself has identifying information about SBC that the 3rd party can clearly identify SBC. SBC does not receive any uniquely identifying information about the user from the 3rd party. As far as SBC is concerned the user is anonymous and has no way of making the user un-anonymous.

IP address and web surfing information

IP addresses are recorded as a matter of regular web site operation. Additional information is collected as well. SBC does not correlate any of the web log information to the user information. SBC does use the information in an anonymous manner to statistically understand how to create a better web site. None of this information is currently shared with 3rd parties, however the statistics and analyzing capability is provided by a 3rd party, specifically Google.com, Clicky.com, visualwebsiteoptimizer.com, WordPress.com, and others. Users are never individually identified.

3rd Party Terms of Service that BearMar.com must pass along

To the extent that the email address is used as part of the WordPress commenting system or that users indicate when commenting they would opt-in to the BearMar.com newsletter, there is no other current use of the email address. The email address is kept private from the public. However, other information in the commenting field is made public such as the web URL or the provided name. SBC may have the right to decline or remove the comment if the comment is found to use profanity or be incorrect, insulting and inappropriate – as determined solely at SBC’s discretion. Users may also be banned from the site for such behavior.

Comments are the responsibility of the commenter.

All users of this site indemnify and release SBC and its owners from any and all liability from comments that they make on this site. Users also indemnify and agree to release SBC and its owners from liability of any kind from any and all uses or related uses of this site or its information in exchange for the use or potential use of the site.

Users may request removal of comments which may be removed by SBC at SBC’s discretion. Users agree that the best way to correct a negative comment would be to have other users post comments earned fairly with quality service, on their behalf and agree to utilize commercially reasonable efforts to obtain such positive comments.

Cookies

SBC may use cookies to provide a better web browsing experience to users. SBC does not share cookie information with 3rd parties.

However, 3rd parties that SBC uses to perform specific functions on SBC’s behalf, may utilize cookies. SBC does not get access to those cookies.

Tracking and other creepy stuff that sounds worse than it is

SBC sometimes utilizes capabilities that helps SBC understand the people that come to SBC better.

One in particular is that SBC sometimes (we turn it on and off for speed purposes) utilizes a special pixel from Facebook and may do so from other providers as well – Facebook is used to illustrate the use. When people come to our site and are Facebook users, over time SBC can get a picture of the types of users that come to SBC by utilizing Facebook’s analysis tools. By doing this, SBC can tell Facebook to advertise to a SIMILAR Facebook audience. (As of 2020, SBC has not enabled this, but this is here just in case SBC does)

Here is what Facebook wants SBC to put on this privacy policy – it is lots harder to read than what SBC wrote: “clearly explain that (a) third parties may use cookies, web beacons, and similar technologies to collect or receive information from your website and elsewhere on the internet and use that information to provide measurement services and target ads, (b) how users can opt-out of the collection and use of information for ad targeting, and (c) where a user can access a mechanism for exercising such choice –> www.aboutads.info/choices .”  To opt-out of Facebook tracking, users would need to go to Facebook and modify settings to opt-out. This would be the same with Google.

Advertising

SBC may have advertising on its site. This advertising may be administered by a 3rd party advertising entity. SBC does not share information collected by SBC with 3rd party advertisers.

I have more detail below – please continue reading.

Web Crawlers and Robots

You agree that web crawler is an industry and societally accepted word describing a computer program that reads and analyzes SBC at an expense to the SBC. You agree that web crawling SBC without being consistent with the Purpose may bring irreparable and immeasurable harm.

With the sole exception of the Purpose, web crawlers are forbidden from using this site without express written permission from SBC.

For example, Google is a permitted because Google helps users find and consume information from SBC consistent with the Purpose. Additionally, Yahoo, Bing, Duckduckgo are all permitted web crawlers.

If you are crawling SBC for e-discovery, data acquisition, you are expressly forbidden from using this site. If you are blocked by SBC and circumvent the block, then you agree that you have damaged SBC and that the minimum you agree to pay for such damages is $100,000 not including attorney’s fees (SBCs fees will be paid as well).

Products

SBC may have products that it sells to users. To the extent needed to provide the products to the user, SBC will use that information to deliver that product. SBC may use that information to contact the user at a later date regarding the use of that product or to provide information about related products. Users may inform SBC that they no longer want to SBC to contact them. Contact will be managed through industry standard email management software tools that will provide the opt-in/opt-out capability that users should be familiar with.

SBC does not receive any credit card information. We use industry standard payment processors: Paypal and Stripe. Occasionally, we use the USPS, UPS, and Fedex to deliver your packages. They will have your address information and you agree to be subject to their privacy policy. This is just common sense. Please stop use immediately and do not order from SBC if you have trouble with this.

Email Newsletter

SBC may have a newsletter. SBC cannot send email without having the users email address. In addition to the users email address, other optional information may be collected, at the users discretion. This information is used for providing a fun birthday email and other personalization, such as addressing users by name. This information is not shared with 3rd parties as normal course of business. However, such information may be provided to 3rd parties in the event that BearMar.com sells, transfers, or disposes of, some or all of the assets of BearMar.com. Management of this user information, including the sending of the lists is handled by a 3rd party email list management company (mailchimp for example). SBC believes that these 3rd party email managers provide better security and privacy to the users than managing the email by SBC itself. Users are sent opt-out information in every newsletter so that it is easy to opt-out. Opting out from the email newsletter will ensure no more newsletters from SBC.

Errors and Omissions

SBC believes that this policy is  accurate. However an error or omission can occur. To correct, SBC would enjoy being contacted by any party bringing the issue to SBC’s attention. SBC will then update the policy to reflect the current state.

As part of using BearMar.com, the user understands that SBC does not provide any warranty or guarantees and that the user uses this information completely at their own risk.
